The Minnesota Habeas Project is a collective of nonprofit legal service providers, law school clinics, and pro bono law firms that seeks to assist unlawfully detained immigrants by
connecting them to pro bono lawyers who can file habeas petitions for them in federal court seeking their release from immigration detention.

The Minnesota Habeas Project will host the first in a series of trainings focused on filing and litigating habeas petitions for Minnesota community members who have been taken into immigration detention.

Habeas Petitions for SIJS Beneficiaries and Unaccompanied Children

This session will focus on habeas claims that can be made for certain immigration youth (18+) who have already been deemed to merit protection under U.S. law: young people granted Special Immigrant Juvenile Status, and/or those who were previously determined to be “unaccompanied children.”

Habeas Petitions for Noncitizens DHS Alleges to be Detained Under 8 U.S.C. § 1225(B)(2)(A)

This session will focus on habeas claims for individuals the government asserts are detained pursuant to 8 U.S.C. § 1225(b)(2)(A), a mandatory detention law. It will describe key arguments,
provide updates on the Maldonado Bautista class action litigation and whether to seek enforcement of that judgment, discuss potential Fourth Amendment claims, and flag common
issues that may arise related to Matter of Q. Li and/or classification as an “arriving alien.” The presenters will also describe trends in rulings from District of Minnesota judges, typical timelines and habeas case progression.

Habeas Petitions for Noncitizens Re-Detained After Release on an Order of Supervision

This session will focus on habeas claims for individuals with final orders of removal who were previously released on an Order of Supervision (“OSUP”). It will include a deep dive into the
governing regulations as well as claims against potential third-country removal and Fourth Amendment violations.

Getting Involved

Attorneys interested in being involved with the project should fill out the Minnesota Habeas Project - Attorney Sign-up Form. In particular, attorneys should fill out the information below to be added to:

  1. a list of volunteer attorneys who have either
    • federal court experience or
    • substantive immigration law experience and want to partner with a
      federal court litigator on the habeas case; and/or
  2. a list of experienced immigration attorneys currently taking referrals for
    immigration habeas cases.
