Prof. McGeveran Calls Mall of America Claim "Legally Cray-Cray"
The St. Paul Pioneer Press interviewed Professor William McGeveran about a lawsuit by the Mall of America against organizers of a pre-Christmas protest at the mall planned by Black Lives Matter. The mall sought not only to bar individual protestors, which McGeveran explained was well-suported by prior precedent, but also to control organizers' online activity. The Mall requested a temporary restraining order prohibiting statements about the protest on social media and requiring that organizers send out messages announcing it had been canceled. McGeveran, an expert on social media and internet law, said that the first of these remedies was contrary to established doctrine and the latter, which would compel speech as a preliminary remedy, was "legally cray-cray."
