Prof. Meili Publishes Post on Trump Executive Order on Refugees
Professor Stephen Meili has published a legal analysis of President Trump’s recent Executive Order on Refugees, most familiarly known as the travel ban. The Order created a 120-day moratorium on the U.S. refugee resettlement program, indefinitely barred the entry of refugees from Syria, and suspended for ninety days the entry of nationals (i.e., refugees or other persons) from seven specific countries: Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen. Prof. Meili analyzes the legality of the ban from several perspectives, including U.S. immigration law, the due process clause of the Fifth Amendment to the U.S. Constitution, and the No Establishment clause of the First Amendment to the U.S. Constitution. Prof. Meili’s analysis includes references to the recent Ninth Circuit Court of Appeals decision upholding a stay on the Order, and a discussion of the likelihood that a revised Order in the wake of that decision will pass Constitutional and statutory muster.
