Prof. Meili Presents Research on Comparative Detention Practices at Fordham Law School
Professor Stephen Meili presented his research on the impact of human rights treaties on the detention of asylum-seekers in the U.S. and the U.K. at Fordham Law School's Leitner Center for International Law and Justice. The detention of asylum-seekers in both countries has increased dramatically over the past 15 years. Meili's talk focused on recent court cases in each country which have addressed the legality of detaining asylum applicants pending a decision on their claim. He described the human rights instruments applicable to these practices and how courts have interpreted them when adjudicating challenges on due process and human rights grounds. A recent decision by the U.K. Court of Appeals suggests that human rights treaties offer protections to detained asylum-seekers in the U.K. that are not available in the U.S.
