Prof. Painter Quoted in The Hill on Obama's Recess Appointments
Professor Richard Painter was quoted in an article in The Hill on legal challenges to President Obama's recess appointments. Business groups claim the appointments are not valid because Congress was not in "recess" at the time of the appointments. The Administration argues that the lawmakers convene "sham" sessions over the holidays in order to prevent the President from making the appointments. Painter observed that while these suits turn on technical questions, the courts should decide the question quickly as it is important to know whether the appointees validly hold their offices.
