Prof. Kristin Hickman Offers Opinion in Bloomberg Law About Supreme Court Justices and Chevron

Professor Kristin Hickman was quoted in Bloomberg Law regarding the overturning of the Chevron deference and whether the ruling was a personal one for Justice Neil Gorsuch. He was a frequent critic of Chevron while he was a federal appeals court judge. Prof. Hickman is among several legal scholars that reject the idea that overturning Chevron represents a victory for Gorsuch. “These are real people with real legal concerns at stake here and they’re the ones who win or lose cases, not judges or justices,” she said, noting that Gorsuch wasn’t the only justice to express concerns about Chevron. “Justice Thomas has been pretty clear that he is at least skeptical that Chevron passes constitutional muster.”
