The United States Court of Appeals for the Second Circuit cited Professor Allan Erbsen’s article From “Predominance” to “Resolvability”: A New Approach to Regulating Class Actions, 58 Vand. L. Rev. 995 (2005). The Court quoted Erbsen’s article in the course of deciding whether to certify a proposed class action alleging labor law violations in Myers v. Hertz Corp.
