Prof. Cotter Quoted on Noncompete Agreements
Professor Thomas Cotter was quoted in the Sioux Falls, South Dakota Argus Leader in a story concerning a lawsuit between Marco, Inc. and Advanced Systems, Inc. involving alleged violations of employee noncompete agreements and of the Uniform Trade Secrets Act. Cotter stated that noncompete agreements are a common way for employers to try to protect their interests in trade secrets and other confidential information, but that in most states, a noncompete is enforceable only if the court deems it to be reasonable.
