Unfair Competition

This course provides an overview of false advertising and product disparagement under the Lanham Act; the right of publicity; and trade secret law.   The course does not provide comprehensive coverage of antitrust, trademarks or trade dress, or consumer protection law.

Note: in some years this course may be offered for three rather than two credits.  In those years, additional topics will include false advertising under the Federal Trade Commission Act; common law claims relating to the unauthorized use of uncopyrightable facts and ideas; cybertrespass; tortious interference with contract and with prospective business relations; civil RICO; and federal preemption of state unfair competition laws.
