Prof. Daniel Schwarcz Paper Discussing National Association of Insurance Commissioners Cited by Wall Street Journal Opinion Piece
A paper by Professor Daniel Schwarcz, Fredrikson & Byron Professor of Law and Distinguished University Teaching Professor, was cited a Wall Street Journal opinion piece by Patrick Brenner, president of the Southwest Public Policy Institute. It discussed the National Association of Insurance Commissioners (NAIC) which supports state insurance regulators, creates best practices, and coordinates oversight. It points out that in Prof. Schwarcz’s paper published in the Connecticut Insurance Law Journal, “Is U.S. Insurance Regulation Unconstitutional,” Prof. Schwarcz said this arrangement by the NAIC effectively means than an unelected body holds control over insurance regulation in states.
