Professor Fionnuala Ní Aoláin, Regents Professor and Robina Chair in Law, Public Policy, and Society, wrote a blog post—part of a joint series with EJIL:Talk! and Just Security — on the updated commentary on the Fourth Geneva Convention. She analyzed Article 27, which covers the treatment of protected persons, and assessed whether the new, updated commentary can overcome the original treaty’s structural limitations. She said that while the commentary is rigorous and progressive, it is still limited by the original text, and that despite improvements, the fundamentally gendered nature of the Geneva Conventions remains a challenge that will take decades to fully address.
