Prof. Matthew Bodie Interviewed by Bloomberg Law About Labor Law Polarization in Federal Appellate Courts

Professor Matthew Bodie, Robins Kaplan Professor of Law, spoke to Robert Iafolla at Bloomberg Law regarding a study of partisan differences in judicial review for federal labor law cases. The analysis found that the National Labor Relations Board enjoyed varying degrees of success within appellate review depending on the composition of the three-judge panel. Democratically-appointed judges were more likely to find in favor of the board, while GOP-appointed judges were less likely to do so. Moreover, the Board was less likely to win within federal circuits that had a higher overall percentage of Republican appointees. Speaking specifically about judges appointed by President Trump, Professor Bodie said: “Trump judges are more willing to question established precedent and upend them,” noting that these judges “are taking signals from the Supreme Court and are more willing to push boundaries.”
