Prof. Linus Chan Interviewed on Minnesota Daily Podcast About Effects on Community Due to ICE

Professor Linus Chan, James H. Binger Clinical Professor of Law, was interviewed on the Minnesota Daily podcast “In The Know.” Among the many topics discussed, Prof. Chan talked about the ability of community members to continue to live their lives while chaos inflicted by ICE has occurred around them. He described the phenomenon of there being an “administrative” state and a “prerogative” state. He said “The idea here is that the administrative state is what normal people, what the majority of citizens need the law to do and function. If you want to be able to travel or if you want to do any number of normal things and you are not part of the vulnerable minority and the government has no interest in, in treating you any differently, then there is a whole system of laws that act and, and do things relatively normally. This is why, of course, right, commercial activity is relatively still stable. In many ways, a lot of people’s day-to-day life may not be affected. And then you have what’s called the prerogative state. The prerogative state is where, anywhere in the situation where the, where the government believes that they could act purely on prerogative, and that’s when they target enemies and they target vulnerable.” Listen to the podcast.
