Prof. Matthew Bodie Interviewed by New York Times Regarding NLRB’s Decision to Drop SpaceX Labor Charges 

Professor Matthew Bodie, Robins Kaplan Professor of Law, was interviewed by the New York Times about the decision of the National Labor Relations Board (NLRB) to end its investigation into unfair labor charges leveled against SpaceX. The eight employees had filed charges with the NLRB accusing SpaceX of firing them for their criticism of CEO Elon Musk. The NLRB reportedly dropped the case after another federal agency, the National Mediation Board (NMB), claimed jurisdiction over SpaceX as a “common carrier by air” similar to airlines. Commenting on this claim of jurisdiction, Prof. Bodie said that there was a certain literal logic to the NMB's assertion of jurisdiction, but that it’s “a stretch” to call the company a common carrier as “SpaceX operates very differently than the airlines.”
