Prof. Ilan Wurman Interviewed by Associated Press About Minnesota’s Lawsuit Against DHS

Professor Ilan Wurman, Julius E. Davis Professor of Law, was interviewed by the Associated Press about the lawsuit filed by Minnesota, Minneapolis, and St. Paul to try to stop the immigration enforcement surge. The lawsuit seeks a temporary restraining order to halt the enforcement action or limit the operation. A ruling could come this week. Prof. Wurman said he doubts the state’s arguments will be successful. He said immigration enforcement is clearly a matter of federal control. He said, “There’s no question that federal law is supreme over state law, that immigration enforcement is within the power of the federal government, and the president, within statutory bounds, can allocate more federal enforcement resources to states who’ve been less cooperative in that enforcement space than other states have been.”
