Prof. Ana Pottratz Acosta Quoted by Star Tribune About DOJ’s Lawsuit Against Minnesota Regarding ICE

Professor Ana Pottratz Acosta, visiting assistant professor and director of the the Immigration & Human Rights Clinic of the James H. Binger Center for New Americans, was quoted by the Minnesota Star Tribune about the many Trump administration lawsuits against states, including Minnesota. The state has responded with Attorney General Keith Ellison joining more than 30 lawsuits to block major parts of Trump’s agenda. One such lawsuit was recently filed against several Minnesota jurisdictions by the Justice Department over sanctuary policies and their lack of collaboration with ICE. The legal is question is whether the government’s demands violate the anti-commandeering principle under the 10th Amendment, which prohibits the federal government from compelling states to enforce or adopt its laws. Prof. Pottratz Acosta said, “In a world where we didn’t have a lot of volatility in terms of the decisions coming out of the Supreme Court, it would be fairly open and shut in terms of this being a violation of the 10th Amendment and anti-commandeering, But it’s hard to say how the litigation is to play out.”
