Prof. Linus Chan Quoted in Star Tribune Op-Ed About Birthright Citizenship

Professor Linus Chan, James H. Binger Clinical Professor of Law, was quoted in a Minnesota Star Tribune op-ed that discussed the reinterpretation of birthright citizenship by the administration and the lack of the U.S. Supreme Court more clearly defining the 14th Amendment. Last month the court only took steps to limit universal injunctions by federal district courts regarding the issue. Prof. Chan described the confusion now caused by the court. He said, “Thirty days after this Supreme Court decision” — the time the court gave plaintiffs to adjust to its ruling before the executive order takes effect — “there may be certain parts of the country where some people born in the United States won’t be recognized as U.S. citizens and won’t be able to get passports or other recognition. Until the Supreme Court actually decides the birthright citizenship question, they will be in that uncertain state. Most people assume that the court will eventually make that decision, even if we can’t be sure when that will happen.”
