Profs. Jill Hasday and Ilan Wurman Interviewed by WCCO News About President’s Authority to Deploy National Guard

Professors Jill Hasday and Ilan Wurman were interviewed by WCCO News regarding the president’s authority to deploy the National Guard rather than allowing the executive authority of Governor Gavin Newsom to determine whether the California National Guard is needed in Los Angeles. Prof. Wurman said, “Federal law is supreme over state law and state executive decisions” which allows the president to call out the National Guard despite the opposition of any governor. An additional question is whether there is rebellion or insurrection occurring in Los Angeles which would determine if deployment can be done for purposes beyond everyday law and order. Prof. Hasday said, “Does rebellion mean something like a civil war has broken out — like a suspension of ordinary operations — or does rebellion mean there is a relatively small group of people who are unhappy?” Watch the interview.
