Professor JaneAnne Murray was quoted by CNN about the possibility of Derek Chauvin, convicted of murdering George Floyd, receiving a federal pardon and the effects on the state conviction if that occurred. Conservative commentator Ben Shapiro floated the idea of a pardon last week. Prof. JaneAnne Murray said that in Minnesota, those seeking a state pardon must apply to a clemency review commission, which then makes a recommendation to the state board of pardons — comprising the governor, attorney general, and chief justice. At least two of three board must vote infavor of the pardon for it to be granted. She said, “Most pardons are cases where people have been out, have finished their sentence. There usually isn’t a question about guilt. It’s about the fairness of the punishment and how long that punishment should play a role in impeding their life opportunities.”
