
Prof. Alan Rozenshtein Quoted by Forbes About Actions Trump Could Take After Supreme Court Upholds TikTok Ban
Professor Alan Rozenshtein was quoted by Forbes about the TikTok ban that was upheld today by the Supreme Court. The federal ban on TikTok is set to take effect Sunday. In an unsigned opinion the Court said federal law “neither references the content of speech on TikTok nor reflects disagreement with the message such speech conveys,” the justices argued, even as they acknowledged the policy “certainly burdens [TikTok’s] users’ expressive activity in a non-trivial way.” Reports suggest Donald Trump is considering an executive order that would quickly reinstate the app, but he may have limited options — and his attempts to stop it could be challenged in court. Prof. Rozenshtein said Trump could also similarly just declare TikTok in compliance with the law — regardless of whether or not it’s actually separated from ByteDance — which would keep TikTok legal but similarly leave room for the move to be challenged in court or ignored by companies if ByteDance hasn’t actually divested.
