Operation Metro Surge represented an unprecedented shift in federal immigration enforcement, resulting in thousands of arrests and significant constitutional questions across Minnesota. As the legal community grapples with the aftermath, the James H. Binger Center for New Americans has led the charge in defending the due process rights of the detained. 

This session provides a critical update on the "habeas project," exploring how practitioners are using federal court litigation to challenge unlawful detentions. Attorneys will learn about the current legal landscape post-surge, including key arguments regarding mandatory detention, Fourth Amendment violations during enforcement, and the evolving role of habeas corpus as a vital tool for liberty in an era of mass enforcement.
